Terms of Service (ToS)
These Terms of Service together with any additionals terms and policies apply to all services and products offered by Mynymbox LLC ("Mynymbox", "us") and form the legal agreement between you ("you", "Client"). These Terms of Service are collectively referred to as this agreement ("agreement", "ToS"). All services offered by Mynymbox are exclusively available for legal activities. Prior to purchasing a service from Mynymbox, you have to ensure and declare that you have read, understood and agreed to our Terms of Service. Mynymbox complies with local laws of the countries we do business with. By using our services you accept and agree this Terms of Service together with all additional terms and policies.
The following list contains our additional terms and policies attached and considered collectively with this Terms of Service:
Account Setup / Registration
It is the Clients responsibility to ensure that your provided email address is valid and up to date at all times. If there is ever an abuse issue or we need to contact the Client, the provided email address from the Client will be used for this purpose. Failure to do so constitutes a breach of the ToS, which may result in immediate termination of your account on our Service.
Jurisdiction and Jurisdictional Disputes, Legal Responsibilities
The parties expressly recognize that, where Mynymbox is acting solely as Client's Host, Mynymbox is not engaged in, and is not actively soliciting, interstate or international commerce for said Client. Where Mynymbox is a named party to any type of dispute or litigation involving any acts by Client that affect out-of-state persons or entities, the Client agrees that it shall indemnify, hold Mynymbox harmless, defend Mynymbox exhaustively (including all legal cost(s), and challenge the jurisdiction of out of state authorities over Mynymbox). Any legal issue must be resolved by the laws in the Nevis. Mynymbox is not responsible for any content and material created or accessible on or through Mynymbox's networks and services that is not directly posted by Mynymbox.
Availability and Backups
Mynymbox shall store Client web sites, files, email and databases on their servers. The parties expressly recognize that internet servers and links are susceptible to crashes, down time, vulnerabilities and that from time to time Mynymbox may need to preform maintenance on their services. Clients with unmanaged services have to manage their own backups at their own expense. Mynymbox is not responsible for data that you may have lost due to said crashes, down time or vulnerabilities. In addition Mynymbox will not support illegal activities by providing you with a backup if your service contains any of the materials found in the Acceptable Use Policy. Due to the nature of computer hardware, Mynymbox is not liable for any data loss occurred.
Maintenance
Mynymbox may temporarily suspend all services for the purpose of repair, maintenance or improvement of any of its systems, or whatever it deems necessary to maintain adequate services. However, Mynymbox shall provide prior notice within 24 hours for all scheduled maintenance. Emergency maintenance may be carried out at any time, with or without notification. Invalid rDNS records may be removed at our sole discretion. For all customers, efforts must be made to ensure that their service do not get listed, banned or blocked, by any firewalls or blacklists. Mynymbox will not be able to provide a replacement IP address for actions caused by customer's negligence.
Security
The parties expressly recognize that it is impossible to maintain flawless security, therefore the customer is solely responsible for properly securing their hosting service provided by Mynymbox including changing initial passwords and making any security adjustments and patches over time. The Client is solely responsible for any damage caused by such unauthorized access, and the Client indemnifies and holds Mynymbox harmless for any compromise of Client's security that resulted from their own actions, the actions of Mynymbox or the actions of any third party. The Client is responsible to keep passwords safe and not disclosure it to any third parties. The Client must notify us immediately upon becoming aware of any breach of security or unauthorized use of the Customer account.
Refunds
All sales are final and no refund will be issued.
Copyright & Abuse
Any Abuse Notification should be submitted in proper form and way. For the Abuse Notification you can use our Ticket System or send an email to abuse@mynymbox.net. The notification should include a description of the abuse and the way of abuse, a contact information of the sender and documents of evidence.
If we receive a valid Abuse Notification we forward a copy to the Client via email and suspend the service from the Client. The Client is obliged to respond to the email within 48 (fourty-eight) hours from the receipt of the Notification from Mynymbox LLC. If we do not receive an answer in the given time from the Client we terminate the service without any refund.
Mynymbox is not responsible for copyright infringements caused by what the Client hosts on Mynymbox's servers. Mynymbox has 0 tollerance for illegal activities and spam. Hosting child pornography, terrorist propaganda, but not limited to, is COMPLETELY forbidden and any client found to be doing so will be cancelled immediately upon discovery.
Payment Information
Mynymbox accepts cryptocurrencies like Bitcoin, Lightning, Litecoin and Monero and other cryptocurrencies directly with our self hosted Crypto Payment Gateways without any third parties. All services are prepaid. We will send you an invoice for your service renewal 14 days before its due date. If we do not receive payment by the due date the service will be deleted and all data will be removed. Mynymbox will not activate new orders or activate new packages for Clients who have an outstanding balance with Mynymbox. For a new order to be setup or a new package to be activated, you must have a balance of 0.00 EUR, unless otherwise stated by Mynymbox in writing.
Resource Utilization
If Mynymbox determines that your account is utilizing an unacceptable amount of system resources, we may temporarily deactivate the account in question. If we deem it necessary, an eviction notice may be sent to the customer of an offending account providing them with five (5) days in which to locate a new provider.This only occurs in extreme cases.
Clients are not permitted to run programs in the background on shared hosting servers. This tends to use a lot of system resources, and can impair service to other customers on that server.
It is strongly forbidden to use the mail service for mass mailings (regardless if it's SPAM or not). Using SPAM to advertise a site hosted on Mynymbox also constitutes as a violation of this provision.
Domain Name Services
Client domain names are registered under the name of Mynymbox LLC on behalf of said Client. Mynymbox shall not have the actual ownership of the domains registered through our system. The Client retains the right to sell, transfer, assign, control, renew each domain name registration upon expiration, being as well responsible to resolve any and all monetary or other legal claims that arise in connection with Client's domain. We do not guarantee that you will obtain the domain name applied for, even if your inquiry has indicated that the domain name is available at the time of submission. Mynymbox provides no warranty with regard to the offered services. Domain registration, renew or transfer fees may change at any time. Our domain search engine can not detect if a domain is a premium domain and will always return as free, this is due to the fact the API to the domain registrar does not return this information. We reserve the right to cancel the domain purchase and credit the paid amount to your customer account. The Client can use the credited funds to order a new domain name. If the client wishes to buy the premium domain for it's price we can arrange such buy after funds have been received. We do not process any domain names which can be used for phishing, violates copyright and trademarks or violates our Terms of Services and Acceptable Use Policy. We cancel such orders and do a refund in form of account credits. If the domain name is already registered and we see that it is used for phishing we will suspend the domain.
Order Processing
Shared Hosting and VPS Servers are configured to be setup automatically after a successful payment. Dedicated Servers setups can take up to 48 hours.
Domain Names orders are screened and processed manually within 24 hours. There is no auto-completion process and require manual action on our behalf to complete for some reasons like fraud protection.
Placed but unpaid orders for more than 24 hours may be deleted from our system.
Support
All services of Mynymbox are unmanaged unless otherwise specified on the product information. Support tickets are usually answered within 24 hours. Sales related tickets have a lower priority and therefore the answer can take longer. We always prioritize existing customers and services over incoming tickets.
Final note
Failure by either Mynymbox or the Client to enforce any of the provisions of this Agreement or any rights with respect hereto or the failure to exercise any option provided hereunder shall in no way be considered to be waiver of such provisions, rights or options, or to in any way affect the validity of this Agreement. If one or more of the provisions contained in this Agreement are found to be invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not be affected. This Agreement may be executed in any number of counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. Mynymbox reserves the right to modify and update this document as needed. If you do not agree to the changes applied to our Terms of Service you shall suspend your Service(s) with us. Your continued use of our website and Services indicates that you have read, understood, and agreed to our Terms of Service.
